14.12.02 Endemol files claims against Mexican TV Azteca |
(Barcelona, Spain, December 2002) - Gestmusic Endemol has filed a claim against TV Azteca before the Mexican Institute of Industrial Property (IMPI). Gestmusic Endemol accuses the Mexican network of unfair competition and argues damage to its successful Spanish format Operación Triunfo.
Recently TV Azteca started broadcasting a similar talent contest in Mexico under the name of 'La Academia'. The use of this title by TV Azteca is unauthorized because Gestmusic Endemol already registered the mark 'La Academia' in IMPI.
In addition, TV Azteca completely plagiarized the format of Operación Triunfo and applied it to its own programme La Academia. The complaint is accompanied by evidence in which TV Azteca uses advertising photos of young people that participated in the original reality show.
TV Azteca has been broadcasting La Academia since June 30th and the end date is unknown. On weekdays it is broadcast twice in one-hour programmes, whereas on Sundays there are three broadcastings: 1 special of 30 minutes, a concert gala of 3 hours and a portrait of an ex-pupil of 15 minutes. Operación Triunfo was broadcast in Mexico by Televisa from August 4th until November 10th in daily episodes of 30 minutes and 3-hour galas on Sundays.
Gestmusic Endemol claims discontinuation of the title La Academia and compensation for the damage done to the Operación Triunfo format. In the United States, La Academia is broadcast by Azteca America. Gestmusic Endemol is therefore exploring possibilities to extend the claim to the United States.
